Welcome to McRank (“McRank”, “we”, “our”, or “us”). By accessing or using our platform (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Service.

1. Definitions

• Service: The McRank platform, accessible via the website https://mcrank.net, and its associated features.
• User: Any individual or entity accessing or using the Service.
• Account: A registered profile enabling a User to manage servers, votes, and other activities on the platform.
• Server Owner: A registered User who lists and manages a Minecraft server on the platform.
• Partner: Third-party entities collaborating with McRank, such as payment processors or API providers.

2.Eligibility & Acceptance

By using the Service, you confirm that:

• You are at least 16 years old or meet the minimum age required by the laws of your country.
• You have the legal capacity to enter into these Terms.
• You agree to comply with all applicable local, national, and international laws while using the Service.

3. Description of the Service

McRank provides ranking platform for Minecraft servers. Users may:

• Explore server listings, vote for servers, and view rankings.
• Register and manage their own server entries.
• Access free and premium features as described on our website.

4. Account Registration & Security

1. You must provide accurate and up-to-date information when registering.
2. You are responsible for maintaining the confidentiality of your account credentials.
3. You must immediately notify us of any unauthorized use of your account.
4. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Voting & Ranking Rules

1. Servers are ranked based on the number of unique votes they receive each month. Votes reset on the 1st day of each month.
2. You may not use bots, VPNs, proxies, scripts, or any automated systems to manipulate votes.
3. If we detect fraudulent activity, we reserve the right to:
   • Reset votes.
   • Suspend or freeze the server listing.
   • Permanently ban the server from McRank.
4. Premium payments or credits associated with accounts caught cheating will not be refunded.

6. Payments & Refunds

1. Some features of the Service may require a paid subscription or one-time payment.
2. Payments are processed via Paddle or other authorized payment providers.
3. By making a payment, you also agree to the terms of our payment processor.
4. Refunds are governed by our separate Refund Policy, available on the website.

7. User Conduct

When using McRank, you agree not to:

1. Post illegal, harmful, abusive, defamatory, obscene, or otherwise offensive content.
2. Impersonate other users or entities.
3. Collect or harvest data from other users without consent.
4. Attempt to disrupt or harm the platform’s functionality.

8. Content Submission & License

1. By submitting content (e.g., server descriptions, images), you grant McRank a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute this content for the purpose of operating the Service.
2. You represent and warrant that you own the rights to any content you submit.
3. We reserve the right to remove or refuse any content at our discretion.

9. Privacy & Data Protection (GDPR/CCPA)

1. We respect your privacy and process your data in accordance with our Privacy Policy.
2. If you are located in the EU/EEA, you have the right under the GDPR to:
   • Access your personal data.
   • Request rectification or deletion.
   • Restrict or object to processing.
3. Force Majeure: We are not responsible for interruptions caused by circumstances beyond our reasonable control.

10. Intellectual Property

1. All rights to the Service, including its design, source code, and branding, remain the property of McRank

11. Disclaimer of Warranties

• The Service is provided “as is” and “as available” without warranties of any kind.
• We do not guarantee uninterrupted, error-free, or virus-free operation.
• To the fullest extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

• McRank shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill.
• Our total liability for any claim shall not exceed the amount you paid (if any) for accessing premium services in the last 3 months.

13. Termination

• You may delete your account at any time via your dashboard or by contacting support.
• We may suspend or terminate your account for violations of these Terms, unlawful use, or fraudulent activity.

14. Changes to the Terms

We may update these Terms from time to time. You will be notified of material changes at least 30 days before they take effect. Continued use of the Service after changes means acceptance of the new Terms.

15. Governing Law & Jurisdiction

• For EU residents, these Terms are governed by the laws of your country of residence.
• For all other users, these Terms are governed by the laws of Estonia.
